Fit & Harmony Liability Waiver & Assumption of Risk

Effective Date: 01/02/2026

By booking, purchasing, or participating in any class, session, or service offered by Fit & Harmony, you (“Participant”) agree to the following Waiver and Release of Liability.

1. Assumption of Risk

I understand that participation in fitness classes, aqua fitness, personal training, and massage therapy involves inherent physical risks, including but not limited to:

  • Muscle strains or soreness

  • Injury from physical exertion

  • Slips or falls

  • Cardiovascular complications

  • Risks related to water-based activities

I voluntarily assume full responsibility for all risks of injury or harm.

2. Health Acknowledgment

I confirm that:

  • I am physically capable of participating

  • I have no medical condition that would prevent safe participation

  • I will consult a physician if needed before beginning any exercise program

I agree to inform Fit & Harmony staff of any medical concerns.

3. Release of Liability

In consideration of participating, I hereby release, waive, and discharge Fit & Harmony, its owners, instructors, employees, contractors, and affiliates from any and all claims or liabilities arising from:

  • Injury

  • Loss

  • Accident

  • Illness

  • Damages

Whether caused by negligence or otherwise, to the fullest extent permitted by Florida law.

4. Massage Therapy Disclaimer

Massage services are provided for wellness and relaxation purposes only.

Massage therapy is not intended to:

  • Diagnose medical conditions

  • Replace medical treatment

  • Serve as rehabilitative therapy unless licensed

Clients must disclose injuries, pregnancy, or health conditions prior to sessions.

5. Photo & Media Release (Optional)

I grant Fit & Harmony permission to use photographs or videos taken during classes for marketing purposes unless I request otherwise in writing.

6. Agreement

By booking services, I acknowledge that I have read, understood, and agreed to this waiver.
